Terms and Conditions

1. Acceptance of Terms

By accessing or using our Learning Management System (LMS), you ("the User") agree to comply with and be bound by these Terms and Conditions. If you do not abide by these terms, you may be suspended or terminated from use of the LMS.

2. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the LMS after any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.


3. Eligibility

The LMS is intended for use by individuals who are within one of our contracted sites. By using the LMS, you represent and warrant that you meet this eligibility requirement.

4. User Accounts

  • Account Creation: To access the courses within the LMS, you are required to create an account, including the ‘All About You’ registration form. You must provide accurate and complete information during the registration process.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  • Account Termination: We reserve the right to suspend or terminate your account at our discretion, without notice, if you violate these Terms. In the event your account is suspended or terminated due to the violation of these Terms, your Site (state/county/agency) will be notified.
  • Contract Termination/User Access: In the event your Site (state/county/agency) terminates its contract with the Just in Time Training Network (JIT), you will be notified at least 30 days prior to the contract end date. It is your responsibility to download and save any certificates you have earned. After the termination date, JIT will no longer have access to terminated users’ accounts or provide further support.

5. Purpose

The LMS is intended for educational purposes only, and provides the user with the opportunity to earn certificates for training hours that can be used for purposes deemed necessary by the user.
Once approved for access to the LMS the user will be able to:
  • Enroll in any course that is available to them. (NOTE certain courses are available to specific contracted sites and are indicated as such on the Course information).
  • Access learning materials and resources for review as necessary for continued learning.
  • Track their progress in Courses and maintain their certificates within their User Profile.

6. Integrity

You agree to uphold the highest standards of integrity in your use of the LMS, including:

  • Complying with all applicable academic policies and procedures.
  • View a training video in its entirety prior to accessing the quiz and certificate, and NOT view multiple courses simultaneously on multiple browsers, windows or tabs.
  • Not misrepresenting your identity or credentials.
  • Not falsifying information or data.
  • Not attempting to compromise the security or integrity of the LMS.
  • Not attempting to gain unauthorized access to other users' accounts or the LMS’s systems.
  • Not allowing any other users access to your account.
  • Not creating certificates in any name other than the account holder’s name.

7. Content Ownership, License and Intellectual Property

All content provided by us, including but not limited to courses, materials, and software, is our property or the property of our contracted Sites. You may not copy, modify, distribute, or sell any content from the LMS without our prior written consent.

All trademarks, service marks, logos, and other intellectual property displayed on the LMS are the property of their respective owners. You are not granted any right or license to use any of these intellectual properties without our written permission.

8. Disclaimers and Limitation of Liability

The LMS is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the LMS will be error-free, uninterrupted, or secure. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall we be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the LMS.

9. Links to Other Websites

The LMS and Courses may contain links to other sites. Unless expressly stated, these sites are not under the control of the Just in Time Training Network or that of contracted sites. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Website does not imply any endorsement of the sites themselves or of those in control of them.

10. Indemnification

You agree to indemnify, defend, and hold harmless Just in Time Training and its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the LMS or your violation of these Terms.

11. Termination

Either the Just in Time Training Network or you may terminate your Account. If we terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, we reserve the right to terminate without giving reasons.
